Important: These Terms are intended to be a strong starter template for a public personal-gift campaign, but they are not legal advice and do not create an attorney-client relationship. Have a qualified attorney review them before launch, especially because this Campaign involves money, public statements, tax-sensitive statements, platform rules, privacy, and possible international visitors.
1. Overview and Acceptance
Welcome to The Million Dollar Ask (the “Site,” “Campaign,” “we,” “us,” or “our”). The Campaign is a public, personal gift request and social experiment with the stated public goal of receiving voluntary personal gifts up to $2,000,000. The primary public payment method is Cash App at $TheMillionDollarAsk.
By accessing the Site, sending money, submitting a message, sharing a challenge, or otherwise participating, you agree to these Terms and all policies linked from the Site, including the Privacy Policy, Cookie Policy, and Donation / Gift Disclaimer.
2. What This Campaign Is
The Campaign is a voluntary personal gift request. People may choose to give for entertainment, curiosity, generosity, personal support, social sharing, or any other lawful reason of their own choosing. Participation is optional.
3. What This Campaign Is Not
The Campaign is not a charity, nonprofit fundraiser, investment, loan, sweepstakes, raffle, lottery, contest, product purchase, subscription, pre-order, membership, debt, political contribution, or payment for services. No donor receives ownership, equity, profit share, interest, prize, reward, product, service, tax receipt, voting right, control right, or anything of monetary value in exchange for sending money.
4. Voluntary Gifts and No Consideration
All payments sent to the Campaign are intended to be voluntary personal gifts. By sending money, you confirm that you are giving freely, without coercion, without reliance on any promise of return, and without expectation of receiving anything of monetary value.
You understand that the organizer controls the use of funds and that gifts are not held in escrow, trust, or a donor-advised account. You do not obtain any ownership, management, accounting, reporting, or approval rights over the Campaign or the funds.
5. Age, Capacity, and Authority
You must be at least 18 years old, or the age of legal majority where you live, to send money or submit public content. If you send money on behalf of a business, organization, family member, or other person, you represent that you are authorized to do so.
6. No Charitable Tax Deduction; Tax Responsibility
Unless expressly stated otherwise in a future written update, the Campaign is not a registered charity or tax-exempt nonprofit organization. Gifts to this Campaign are not charitable donations and are not represented as tax-deductible charitable contributions.
Tax treatment may vary based on the donor, recipient, amount, location, and facts. Donors and the organizer are each responsible for their own tax compliance, filings, reporting, and professional advice.
7. Payment Processing and Cash App
Payments may be processed through third-party services, including Cash App. Your use of Cash App or another payment service is governed by that provider’s own terms, privacy policies, security practices, dispute rules, and payment rules. We do not control Cash App’s fees, verification, account reviews, holds, reversals, outages, transfer limits, compliance checks, or security decisions.
You agree not to send funds that are stolen, fraudulent, unauthorized, disputed, restricted, sanctioned, or connected to unlawful activity. We may reject, refund, report, or cooperate with payment processors or lawful authorities regarding suspicious or prohibited activity.
8. Refund Policy
Because all payments are voluntary personal gifts, gifts are generally final and non-refundable. We may consider refund requests at our sole discretion where legally required, where a payment was clearly unauthorized, where a payment processor requires reversal, or where we determine that a refund is appropriate. Payment processor limitations, fees, holds, deadlines, and identity checks may apply.
9. Campaign Stats, Progress Meter, and Manual Updates
The Site may display raised totals, donor counts, challenge counts, milestones, progress percentages, messages, and other figures. These figures may be updated manually from Cash App records or other internal records and may not update in real time.
Displayed figures may be estimates and may change because of fees, refunds, chargebacks, reversals, holds, pending transfers, duplicate entries, delayed records, correction of errors, manual updates, platform restrictions, or fraud review. We may correct, revise, pause, or remove displayed stats at any time.
10. Public Anonymity and Identity Reveal
The person behind the Campaign may remain publicly anonymous unless and until the stated identity-reveal milestone is reached or until disclosure becomes necessary or appropriate. Public anonymity does not mean anonymity from payment processors, banks, tax authorities, hosting providers, security vendors, legal/compliance systems, courts, regulators, law enforcement, or other required parties.
Any planned identity reveal may be revised, delayed, limited, or cancelled if required for safety, legal, tax, platform, fraud-prevention, privacy, security, or compliance reasons. No donor should give in reliance on any guaranteed reveal format, timing, or details.
11. Donor Messages, Challenges, and User Content
If the Site allows donor messages, challenge messages, usernames, nicknames, testimonials, or other public submissions, you grant us a worldwide, royalty-free, transferable, sublicensable license to host, display, reproduce, edit for length or clarity, moderate, remove, decline, publish, and promote that content in connection with the Campaign.
Do not submit illegal, abusive, harassing, hateful, defamatory, obscene, threatening, private, misleading, infringing, or harmful content. Do not submit personal information about yourself or others unless you want it displayed publicly. We may remove or edit content at any time without notice.
12. Prohibited Participants and Prohibited Conduct
You may not use the Site or Campaign to commit fraud, launder money, evade sanctions, impersonate others, harass anyone, exploit minors, submit unlawful content, interfere with the Site, scrape or attack the Site, attempt unauthorized access, or violate the rules of any payment processor or platform connected to the Campaign.
You may not participate if doing so is prohibited by applicable law, payment platform rules, sanctions rules, export controls, or other restrictions. We may block, remove, reject, refund, or report activity that appears suspicious, unlawful, abusive, or platform-prohibited.
13. International Visitors
The Site may be viewed from outside the United States. You are responsible for complying with laws that apply to you in your location, including tax, payment, currency, sanctions, consumer protection, privacy, and online-giving rules. We make no representation that the Campaign is appropriate or available in every country.
14. No Professional Advice
Nothing on the Site is legal, tax, financial, investment, charitable, accounting, or professional advice. You should consult your own advisors before making decisions that may have financial, tax, or legal consequences.
15. Intellectual Property
The Site design, name, text, graphics, badges, slogans, and other materials are owned by or licensed to us except where otherwise stated. You may share public Site links and screenshots for non-misleading social sharing, but you may not copy, resell, misrepresent, or use the Campaign materials to impersonate us or collect money without authorization.
16. Third-Party Links and Services
The Site may link to Cash App, social platforms, analytics providers, cookie tools, hosting services, or other third parties. We are not responsible for third-party sites, terms, privacy practices, security, fees, outages, moderation, or payment decisions.
17. Availability and Security
The Site is provided “as is” and “as available.” We do not guarantee that the Site, payment links, stats, challenge links, admin tools, social sharing, or third-party services will be uninterrupted, accurate, secure, or error-free. You are responsible for using secure devices, strong passwords, and trusted networks.
18. Disclaimer of Warranties
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and security.
19. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, punitive, lost-profit, lost-data, lost-goodwill, payment-processing, tax, platform, or third-party damages arising from or related to the Site, Campaign, gifts, public messages, payment processors, or inability to access the Site.
20. Indemnity
You agree to defend, indemnify, and hold us harmless from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising from your participation, your violation of these Terms, your unlawful conduct, your payment disputes, your user content, or your violation of another person’s rights.
21. Consumer Rights and Non-Waivable Law
Some laws may give you rights that cannot be waived or limited by these Terms. Nothing in these Terms is intended to limit non-waivable rights that apply to you. If any provision is unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law.
22. No Public Jurisdiction Listing
To preserve public-facing anonymity, these Terms do not list a public city, county, state venue, registered agent, physical mailing address, or local legal jurisdiction. This choice is not intended to mislead users, avoid lawful obligations, or prevent valid legal process. Required legal, tax, banking, platform, or compliance disclosures may still be made privately to appropriate parties when required.
23. Changes to These Terms
We may update these Terms at any time. Updates become effective when posted on the Site with a revised effective date. Your continued use of the Site or participation in the Campaign after updates means you accept the updated Terms.
